Introduction 

The Electrical Product Safety Approvals Services offered by MARVIN GLOBAL is based on third part conformity, which is one where a representative sample is provided for testing and certification and does not include any surveillance activities or ongoing product quality control. 

Ongoing conformance of the product with the standard is the responsibility of the certificate holder and the South African importer/manufacturer. 

This document sets out MARVIN GLOBAL Services (Pty) Ltd terms and conditions administrating compliance electrical products and similar apparatus and the obligations of the Applicant/Certificate Holder that must be satisfied to firstly obtain approval from AG and then to maintain the validity and currency of the certificate with the NRCS and ICASA. 
 

  1. Definitions

Applicant: 

The registered business who is applying to be the Holder of a Certificate. 

Certificate Holder: 

The registered business that holds an NRCS/ICASA Certificate of Approval for the product. 

NRCS: 

National Regulator for Compulsory Specifications. 

ICASA: 

Independent Communications Authority of South Africa 

LOA: 

Letter of Authority 

RCC: 

Regulatory Compliance Certificate 

AC: 

Authorization Certificate 

Type Approval: 

Certificate issued by ICASA for the products complying to the type approval requirements 

EMC: 

Electromagnetic Compatibility 

RF: 

Radio Frequency 

RED: 

Radio Equipment Directive 

RoHS: 

Restriction of Hazardous Substances Directive 

  1. Terms, Conditions and Obligations

The LOA/RCC/AC, Type Approval Application forms online or otherwise and Schedule of Fees all form part of these Terms, Conditions and Obligations. 

All information as required by the Regulations be provided to obtain NRCS or ICASA approval. 

Deviations from the Terms, Conditions and Obligations at any time during the Certification life cycle of a product will result in the withdrawing or closure of the application at the cost of the applicant. 

The applicant cannot hold MARVIN GLOBAL responsible for any inaccurate or misleading information that could result in the rejection of your application. 

The application is to be accompanied with all relevant documentation and information as detailed in the Guidelines and Regulations. 

Completing the online Form and will include at least the following: 

  • Test Report/s demonstrating compliance of the product to the applicable Standards (Safety, EMC, RF, RoHS, RED ect)
  • Detailed colour photographs (Usually part of the Test Report)
  • User Manuals
  • Product Brochures
  • Basic Engineering Block Diagram (ICASA Only)
  • Sample where required
  • Regulatory fee
  1. Evidence for Proof of Compliance

A LOA/RCC/AC/Type Approval Certificate is issued for electrical products that show compliance with the relevant Regulations/Acts and Standards. 

Compliance is based on the following order of application of 

Standards: 

  1. South African National Standards (SANS) 
  1. International Electro Technical Commission (IEC) Standards 
  1. European Norm (EN) standards or Harmonised Document (HD) based on IEC Standards with acceptable declarations. 
  1. Any National Standards that show equivalence to IEC Standards 

Where amendments to the existing standards are published, new product applications shall comply with the published amendment. 

Regulations/Acts such as but are not limited to 

  1. VC8003, VC8006, VC8008, VC8011, VC8012, VC8029, VC8035, VC8036, VC8039, VC8043, VC8052, VC8055, VC8075, VC8077, VC9006, VC9008, VC9087. VC9011, VC9105, ICASA Act, NRCS Act 
  1. Product Samples

A sample may be requested if there is a specific requirement such as but are not limited to: 

  • NRCS RCC/AC submissions
  • ICASA Simplified Type Approval submissions- showing equivalence to an existing approved product during

Note, that after testing, the product will not be operational; may be in an unsafe condition. 

  1. Changes and Modifications
  2. Technical Modifications

Any technical changes to the approved product will require resubmission to the NRCS or ICASA. These changes may include modified additional models or other technical changes that would affect compliance under the original Certificate. Where modifications constitute a new type of product the applicant shall apply for a new Certificate. 

  1. Administrative Modifications

Where modifications of an administrative (Contact details, Trading Names ect) or non-technical nature occur to an approved product a request can be made for such change to the Regulators via the online portal. Additional documents might be requested to facilitate the modifications. 

  1. Transfer of Certificates

The LOA/RCC/AC/certificate is issued for use only by the applicant stated overleaf. The certificate may not be given/sold/ceded/traded to any other party, and use of the certificate by any other party other than the stated applicant is an offense. 

If an applicant can prove product equivalence to an already approved product under ICASA then a much simpler process can be accessed. 

  1. Renewal of Certificate

The Certificate Holder has an obligation to ensure the certificate remains current while approved product remains in the marketplace to be sold. 

The renewal application should be submitted between four and six months prior to the expiry date. This ensures enough time for the approval process to be concluded. The NRCS currently has a turnaround time of 120 days and ICASA around 50 days. 

  1. Extension of Certificates

An extension of another 36 months for LOA’s may be approved based on the previous reports submitted to the NRCS. However, there are rules that are applied in these cases. Changes or updates in the standard that are safety critical and were not covered under the previously issued report may warrant an updated test report. 

An extension of another 24 months for RCC’s may be approved based on the previous reports submitted to the NRCS. However, there are rules that are applied in these cases. Changes or updates in SANS 10142 that were not covered under the previously issued report may warrant an updated test report 

ICASA Certificates do not expire. 

  1. MARVIN GLOBAL & Regulatory Fees

The Scheduled ICASA/NRCS Fees is set out the Government gazettes and is available on our website on https://marvinglobal.co.za/downloads 

  • The MARVIN GLOBAL fees include the Regulators fees and are based on a single review, processing, and submission of documentation.
  • Where additional time is required to review and process additional information, charges at published rate will be applied.
  • The applicable fee/s must be paid in South African Rands when the application is submitted.
  • Fees may be paid by Credit Card, Electronic Funds Transfer (EFT) or cheque via our payment partner Payfast.
  1. Non-Conformities during MARVIN GLOBAL Application Process

If non-conformities are identified during the pre-application evaluation process, they shall be documented and raised with the applicant. Only when all non-conformities are satisfactorily addressed shall the application be submitted to the relevant Regulator. If the applicant is unable to fix the non-conformities, 50% of the fees paid shall be refunded. 

  1. Marking of Products

Marking shall be in accordance with the standards and legislative requirements which include, but are not limited to, the following. 

  • Each product must be marked with the information as required by the applicable Standard; and/or
  • Be permanently marked with the approved ICASA type approval sticker where applicable
  • Match the information on the relevant certificates in terms of brand and models
  1. Obligations of Certificate Holders
  • The Applicantsand Certificate Holders have an obligation to take appropriate actions to ensure that manufactured products offered for sale are the same as the approved product. 
  • Applicants need to plan around the turnaround timeframes of the Regulators. There is no priority or special process that can speed up any application. The Regulators work on a FIFO principle. The NRCS’s turnaround timeframes is 120 daysand ICASA is around 50 days. 
  • Applicantsmust ensure payments for certification fees are made with application. MARVIN GLOBAL will then pay the Regulator directly as this needs to be done within 24 hours after the application is submitted. 
  • Certificate Holdershall take full responsibility for their products relating to any Regulatory requirements. 
  • Certificate Holdershall ensure that no certificate or report nor any part thereof is used in a misleading manner. 
  • A Certificate Holder may not reproduce the certificate or any part of the certificate.
  1. Management of Certification Documentation

Certificates remain the property of the applicant and may not be sold/ceded or transferred. Under no circumstances is the certificate or any part of the certificate to be reproduced. 

  1. Confidentiality

Neither Party shall, without the prior written consent of the other Party (which consent may, for the avoidance of doubt, be withheld in the unfettered discretion of the Party called upon to disclose the Confidential Information) disclose such Confidential Information to any person, and/or make use of such Confidential Information for any purposes other than in connection with the rendering of the Consultancy Services. 

The Party receiving the Confidential Information may disclose same to its officers, employees and subcontractors but only to the extent required for the purposes of the rendering of the Consultancy Services pursuant to the provisions hereof. 

The Party receiving the Confidential Information shall inform any officer, employee or subcontractor to whom it discloses such Confidential Information, that such information is confidential and shall instruct them to keep it confidential and not to disclose it to any third party (other than those persons to whom it has already been disclosed in accordance with the terms of these conditions), on the basis that the party disclosing the Confidential Information is responsible for any disclosure, in breach of this clause, by the person to whom it is disclosed. 

Notwithstanding the provisions of this clause: 

either Party may make reference to these conditions, the Parties’ identities and a general description of the Consultancy Services rendered pursuant to and in terms of this Agreement, unless such information is explicitly and specifically identified as Confidential Information on written notice by either Party to the other; and either Party shall be entitled in its discretion from time to time to publish and/or to make known to members of the public, including (without limitation) its shareholding, the details of its financial performance, its financial performance forecast and the Party’s strategic planning. 

  1. Termination

Either Party may immediately terminate this working Agreement by giving written notice to the other Party if the other Party is insolvent or has a petition brought by or Marvin Global against it under the insolvency laws of any jurisdiction, if the other Party makes an assignment for the benefit of creditors, if a trustee, or similar agent is appointed with respect to any property or business of the other Party, or in the case of the Client, if the Client materially breaches its obligations to make payment pursuant to this Agreement. 

Notwithstanding the foregoing, either Party may terminate this working Agreement for any reason or not reason by providing the other Party with immediate written notice of such termination 

  1. Complaints, appeals and disputes

A complaint or appeal or dispute for a decision made during the approvals process can be addressed in writing to the Chief Product Compliance Officer via the MARVIN GLOBAL website (www.marvinglobal.co.za/contact) or directly to info@marvinglobal.co.za 

A member of MARVIN GLOBAL will respond within 2 working days of receipt of this notice. 

  1. MARVIN GLOBAL Web Site

No details of an approval or outcome will be published on the public area of MARVIN GLOBAL’s web site. All information will remain commercial-in-confidence and no personal information will be made public. 

MARVIN GLOBAL must comply with any lawful requests for information by a statutory authority. 

  1. Errors or Omissions

Clerical errors or omissions, whether in computation or otherwise in any certificate, document, quotation acknowledgments, shall be subject to correction. 

  1. Liability

To the fullest extent permissible by law, the Consultant disclaims all warranties, any representations of fitness for purpose of any kind, whether express or implied in respect of the Consultancy Services and the Client utilises the Consultancy Services at its own risk. 

The Client agrees that the Consultant is unable to, and is not required to, guarantee a particular result, or set of technical/commercial outcomes. 

The Client agrees that neither the Consultant nor the Consultant’s Associates shall be liable for any Losses however arising and whatever the cause including, but not limited to, Losses arising because of the Client’s negligence, and/or failure to furnish the Consultant with adequate information it requires in order to render the Consultancy Services, any unknown Regulatory amendments that could affect the application. 

MARVIN GLOBAL shall not be liable to the Client for any loss or damaged directly or indirectly arising out of or in connection with any delay in delivery of the goods, outcome of any application, inaccurate advice, or failure to perform any term of this working agreement.
